SASEGBON ON ELECTION PETITIONS is an overview of the law governing elections in Nigeria as expressed or applied by the appellate Courts in the context of specific Court cases. It is intended to provide those with and those without a legal background with an informative survey of the judicial treatment of the major issues in the area of elections and to serve as a helpful reference tool and starting point for attorneys who wish to conduct research on a specific election-related legal issue.
Numerous principles and statements of law, which have stood the test of time and which have formed the foundation of Nigeria’s ever-developing legal system, are presented in the publication. The work uniquely reflects and presents, in a concise and exhaustive form, the results of accumulated precedents which replaced, modified or supplemented older doctrines during the immediate past 40 years particularly the past 14 years of Nigeria’s nascent democracy which was rife with election petition matters and which have seen significant changes and progress in the Nigerian judicial system.
SASEGBON ON ELECTION PETITIONS does not claim to contain everything you ever wanted to know about election case law nor does it include every Court case related to elections.
The intention in publishing Sasegbon On Election Petitions was to create a greater understanding and appreciation of the vast expanse of legal intellect, laws and Court procedures on the subject, not only among the legal community but also the general public, be they Government Officials, the Military, Ministries, Supreme Court, Court of Appeal, and High Court Judges, Magistrates, Industrialists, Diplomats, the Academia etc.
Part of the inspiration of the Editor in Chief, the late Deji Sasegbon Esq, SAN. to put together this publication was drawn from his participation in a number of sensational election petition matters, the determination of which played a significant part in the development of the law as it relates to election petitions. The cases include: Aregbesola v. Oyinlola (2011) 9 N.W.L.R. (Pt. 1253) 458 and Mark v. Abubakar (2009) 2 N.W.L.R. (Pt. 1124) 79.
USING EACH VOLUME Two finding aids are provided in addition to the Table of Cases and Statutes which appear at the beginning of each volume. This enables the reader to use Election Case Law easily and efficiently, especially when there is an interest in finding a particular topic: A detailed Table of Contents appears at the beginning of each title and a detailed index appears at the end of each title.
The use of the Table of Contents is a convenient way to identify the location of major topics discussed in this publication. Discussions of major subtopics are identified by boldface headings in the text which correspond to entries in the Table of Contents.
